A sidewalk memorial on Ditmars Boulevard that the Department of Transportation deemed illegal is still standing, but the city will raze it eventually, said George Delis, district manager of Community Board 1.
The family of Stefan Trajkovski, a boy killed last April riding his bike after he was hit by an SUV, erected a shrine to him roughly three weeks ago at the corner of 75th Street that resembles a cemetery plot.
Delis put out calls to the family a week ago on behalf of the DOT, asking them to remove the memorial, saying it is illegal because it obstructs the sidewalk and blocks a nearby bus stop.
If someone falls because of the memorial, that person could sue the family, the city and property owner closest to the site, he said.
A DOT official said it is unlikely the family will be fined for erecting the memorial but may be sent a bill for the work it takes to remove it.
The Trajkovskis said last week they would not remove the shrine because they claim it is not an obstruction.
