New York state passes nation’s toughest gun laws

Lawmakers in Albany moved swiftly this week as the state Legislature passed a set of reforms to the state’s gun and mental health laws that Gov. Andrew Cuomo pledged to make a priority in his State of the State speech a week earlier.

The legislation, known as the NY Secure Firearms and Ammunition Enforcement Act of 2013, offers sweeping reforms to the kinds of guns New Yorkers may legally own, how they may acquire them and the penalties for illegally possessing firearms.

The act expanded the ban on assault weapons in the state.

The bill passed the state Senate Monday with bipartisan support and a vote of 43-18. The state Assembly voted 104-43 in favor of the legislation Tuesday afternoon and Cuomo signed the toughest gun control law in the nation shortly after 5 p.m.

State Sen. Malcolm Smith (D-St. Albans) dedicated two parts of the legislation to southeast Queens mothers who lost their sons to gun violence.

“[In] many of our urban centers — Syracuse, Rochester, Albany and particular New York City — we’ve had a rash of illegal gun activities that have taken the lives of a number of young people throughout this city,” Smith said as the Senate voted 43-18 in favor of the sweeping reforms. “Many of you are familiar with them.”

The senator dedicated two pieces of the legislation that increase the penalties for gun possession charges to Donna Hood, whose 13-year-old son Kevin Miller was killed by a stray bullet in 2009, and Shenee Johnson, whose son Kendrick Morrow was fatally shot at a party in 2010.

The legislation also extended Kendra’s Law, which was set to expire in 2015, which grants the courts the authority to involuntarily commit patients with a history of mental illness who fail to undergo psychiatric treatments.

Assemblyman Ed Braunstein (D-Bayside) said the new act was important in light of the killings at Sandy Hook Elementary School in Newtown, Conn., last month and the pushing of a subway rider onto the tracks at the 40th Street No. 7 train station in Sunnyside.

“In light of the tragic murders in Newtown, I was proud to vote in favor of common sense legislation that strengthens existing gun control laws, increases penalties for the illegal use of firearms and ensures that the mentally ill do not have access to guns,” he said. “By strengthening Kendra’s Law, we will make certain that the dangerously mentally ill are not released into our communities to commit heinous crimes, such as the recent subway pushing tragedy.”

Great! Grandstanding by little Andrew and his fake phony Kennedyesque accent! I for one feel much safer already knowing that Little Andy, the fiendish closeted Bloomberg and oh yea the guy in charge with the fake Social security number from Connecticut even though he wasnt born or ever lived in Connecticut, are in control of the assault rifles. Fiendish Bloomberg a proponent of Agenda 21 which is a UN program that will force familes of 4 to live in 250 sq ft micro apartments. All of these freaks are proponents of Rex 84 , a government program to place citizens in concentration camps! Any of you schmucks out there aware that the government recently purchased 1.6 billion rounds of hollow point bullets for "domestic Use"?. Feeling safe and secure? Oh yeah the guy in charge, the Emperor who has no clothes, is best friends with radical Bill Ayers who told an undercover FBI agent that when these freaks get in charge it will be necessary for them to "exterminate" 25 million Americans who will refuse to follow the program. Feeing safe? Twenty something kids in Connecticut was indeed a tragedy, however it is also a tragedy that our govt has killed 160 innocent children in Pakistan with drone attacks and these freaks who stand on the graves of these Connecticut children do nothing and are conspirators in the wholesale slaughter of children through abortion to the tune of about 4000 per day! Who cries for them?

There can no longer be any doubt – the forces of tyranny are running wild across our once great Republic. The time has come for all good men and women to rally to the aid of their country. We have now entered a historic crossroads that will decide the destiny of the United States. Arrogance and corruption has long festered in Washington DC, but the last decade has seen an extreme acceleration of criminal looting and attacks on liberty – every freedom is under sustained assault.

We the People, the rightful masters of this Republic, will either rise up through Congress and the states or we can trade in our birthright of liberty for the chains of a technocratic slavery. Below we list some of the more egregious acts of seditious treason against the Republic of the United States. Anyone who wishes to continue to live in a free country and to pass that birthright on to their children must research this document and then lobby state legislatures and the Congress to do their duty and remove the would-be dictator.
The time has now come for a bill of impeachment to be introduced and debated in Congress. Obama’s crimes are public, and the debate in the House will serve as a court in which to display the tyrannical activities of President Obama and his cohorts. As in the case of Richard Nixon, the exposure of Obama’s crimes may cause him to resign in disgrace. If he does not step down, the full House will then vote to begin the impeachment trial in the US Senate. The time has now come to make your decision – to stand up to evil or get on your knees as a willing slave.

- He has clearly communicated his intent to eviscerate the second amendment rights of American citizens by pursuing executive orders to curtail the right to keep and bear arms without congressional authorization and in violation of the second amendment.

- He has brazenly undermined the power of Congress by insisting his authority came from the United Nations Security Council prior to the attack on Libya and that Congressional approval was not necessary. “I don’t even have to get to the Constitutional question,” said Obama. This is an act that “constitutes an impeachable high crime and misdemeanor under article II, section 4 of the Constitution,” according to Congressman Walter Jones.
- He has ignored Congressional rejection of the cybersecurity bill and instead indicated he will pursue an unconstitutional executive order.
- He has signed into law the National Defense Authorization Act which includes provisions that permit the abduction and military detention without trial of U.S. citizens, violating Habeas Corpus. Despite Obama claiming he would not use the provisions to incarcerate U.S. citizens, it was his administration that specifically demanded these powers be included in the final NDAA bill.
- He has enacted universal health care mandates that force Americans to buy health insurance, a clear violation of the Constitution in exceeding congressional power to regulate interstate commerce. Obama has also handed outpreferential waivers to corporations friendly to his administration.
- He has declared war on America’s coal industry by promising to bankrupt any company that attempts to build a new coal plant while using unconstitutional EPA regulations to strangle competition, ensuring Americans see their energy costs rise year after year.
- He has violated the Constitution’s Takings and Due Process Clauses when he bullied the secured creditors of automaker Chrysler into accepting 30 cents on the dollar while politically connected labor unions and preferential others received better deals.
- He has violated Article II of the Constitution by using signing statements as part of his executive usurpation of power.

An assault rifle was not even used in the shootings in Sandy Hook. Yet Cuomo comes out with a statement about hunters not needing a clip that hold ten rounds. What Cuomo neglected to tell non hunters or member of the senate that in the DEC hunting regulations there is already a limit to the number of rounds a gun can carry to be legally used for hunting or is he ignorant about this law as well. Anything can be used to assault someone if someone is killed with a hammer does that make other hammers made the same way asault hammers. How many people get killed by cars maybe they should be banned also how far does this stupidity have to go before someone stands up and says enough. These are elected official who were voted in to represent us not their own personal agenda's. If New York wanted this law shouldn't it have been voted on by the people of New York what ever happend to the democratic system ? Our elected officials are above this now ? What about the President who now wants diciplin in schools it was the government that took it out to begin with and away from the parents. When I grew up there was no such thing as ADD if my Parents wanted to get my attention it happened in a heartbeat and the punishment I got at school didn't hold a candle to the punishment I knew was waiting for me at home. You know something there was never things like people or supposedly mentally ill kids running around doing anything Imagine that. So instead of passing stupidity go back and check the stupidity you already passed thats gotten us where we are.
